Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the www.dailycarecalls.com website (the “Service”) operated by Daily Care Calls (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Our Services

Daily Care Calls is providing a subscription-based real person service: daily phone reassurance calls, and companionship calls. Calls may include but are not limited to, any or all of the following phone-based services: daily check on the customer, activity, meals, medication, pets care reminders or long casual conversations.

You understand that Daily Care Calls is not a healthcare provider and any statements made by Daily Care Calls or our representatives during a phone call are not intended to be a substitute for professional medical advice, diagnosis, or treatment. You agree to always seek the advice of your physician, or another qualified health provider.

If we are unable to reach you by phone, after three attempts within 1-hour, we will attempt to notify your emergency contact person via telephone, text message, or email.

You are responsible for providing accurate information and keeping your information up-to-date. This includes your phone number and emergency contacts.

Refunds and Fees for Services

Upon sign up for the Daily Care Calls service, you agree that your credit card will be charged in accordance with the pricing terms presented to you for that service. Your plan subscription will automatically renew as the Service is billed in advance on a monthly basis and considered as non-refundable. There will be no refunds or credits for partial months of service.
The best time to make any changes to your plan is at the end of your billing cycle.

You are responsible for providing accurate information and keeping your information up-to-date. This includes your phone number and emergency contacts.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Daily Care Calls and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Daily Care Calls.

Daily Care Calls has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Daily Care Calls shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Recordings of Phone Calls

We might record some conversations with our customers. However, these recordings will not be released unless where required to do so by law or subpoena.  Occasionally ‘special category’ personal information may be recorded where a customer voluntarily discloses health, religion, ethnicity, or criminal information to support their request for advice and/or services.  We keep this information confidential and do not provide legal advice.
*For the safety of your loved ones, we will have a 3rd party record phone conversation we have with them. This isn’t to break the privacy they have, these recordings will be confidential and only provided in case of an emergency. We will be using “MightyCall” who has many positive ratings. They are able to keep these recordings for up to 30 days.

Telephone call recording will be turned off, when a customer’s credit or debit card details are given, in line with Payment Card Industry Data Security Standards (PCS DSS) and data protection legislation including General Data Protection Regulations (‘GDPR’).

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

We may share your personal data between our Third-party partners and business affiliates where it is necessary to perform the services provided to you.

In order to verify payment methods and prevent fraud, Stripe and/or PayPal verify personal information, including payment information, payment providers, and fraud prevention services.  We may use automated decision-making systems to verify payment methods, assess creditworthiness, or prevent fraud, and we may contact you requesting additional information when needed.

We may share your personal information with Third Parties only as necessary to complete a transaction or perform a service that you have requested, or to support the technical operation and maintenance of our services and of our website. We require those Third Parties to protect any personal information they may receive in a manner consistent with this Policy.

We do not provide personal information to Third Parties for the marketing of their own products and services without your consent.

Our Service does not address anyone under the age of 18 (“Children”).

If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us. If we discover that a child under 18 has provided us with Personal Information, we will delete such information from our servers immediately.
